Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) forms part of our Terms of Service and applies to every service you purchase or use through mildnode.com. You accept it at checkout.
1. Your role and ours
Mildnode (David Miler) provides a platform and a done-for-you setup and hosting service. We are a technical intermediary and reseller. You are the legal owner of the domain you purchase and are solely responsible for how the services — including your mailboxes — are used and for all content you transmit, store, or publish. As your managed email host we have technical administrative access to the mail system; we access mailbox content only as set out in our Privacy Policy, and we cooperate with lawful requests as described there and below.
2. Prohibited uses (general)
You must not use any service provided through mildnode.com to:
- send spam or any bulk, unsolicited, or unlawful commercial messages;
- send phishing, spoofed, deceptive, or fraudulent messages, or impersonate any person or entity;
- distribute malware, ransomware, or any harmful code, or attempt to gain unauthorized access to any system, account, or data;
- host, store, link to, or transmit illegal content, including content that is child-sexual-abuse material, terrorist, or otherwise unlawful;
- infringe the intellectual property, trademark, privacy, or other rights of any third party (including logos or brand assets you submit to us);
- engage in fraud, deception, pyramid or “get rich quick” schemes, or any other unlawful activity;
- violate the acceptable-use or anti-abuse rules of any underlying provider (your domain registrar, email-hosting provider, DNS host, or payment provider).
3. Email-specific rules (anti-spam)
Because we operate your mailboxes as a managed service on shared infrastructure, misuse of email can harm other customers’ deliverability and our providers’ reputation. In addition to the above, you must not:
- send unsolicited bulk or marketing email, newsletters to purchased or non-opted-in lists, or any message that violates anti-spam laws;
- forge headers, falsify the sender, or relay mail through third-party systems without authorization;
- exceed reasonable sending limits or use the mailboxes as a bulk-mailing platform (a dedicated email-marketing provider must be used for permission-based campaigns);
- send messages that result in excessive bounce rates, spam complaints, or blocklisting.
4. Your warranties
You warrant that your use of the services is lawful and that you hold all rights necessary for any content or assets you submit to us or transmit through the services (for example, a logo used in an email signature, or the messages you send from your mailboxes).
5. Indemnification
You agree to indemnify and hold Mildnode harmless from any third-party claims, damages, or costs arising from your use of the services or from content you provide, transmit, or publish, in accordance with our Terms of Service.
6. Reporting abuse and notice-and-takedown
Suspected misuse can be reported to contact@mildnode.com. Where we become aware of unlawful or infringing use, we will act without undue delay and may warn you, disable or remove the affected content or service, or suspend or terminate your service. We cooperate with lawful requests from courts and competent authorities.
7. Consequences of a breach — suspension and termination without refund
We may suspend or terminate any service that is used in breach of this policy or applicable law immediately and without prior notice. Where the breach is attributable to you, such suspension or termination is without any refund of fees already paid, and does not limit any other remedies available to us, including a claim for damages or indemnification. This applies in particular to any use of the mailboxes for spam or unlawful activity.
